Party wall in Witham

Do I need a party wall agreement in Witham?

When you carry out works covered by the Party Wall etc. Act 1996, you as the Building Owner have to serve notices and get consent from the neighbouring Adjoining Owners. If consent isn’t given, the matter is deemed to be in dispute and surveyors must be appointed to resolve it with a Party Wall Award. In everyday use, either the consent or the award is your “party wall agreement”.

Typical projects that need notice include:

Rear and side-return extensionsLoft conversions with steel beams into the party wallChimney breast removalNew foundations within 3m of a neighbourGarden walls on the boundary
Planning permission isn’t the same thing. Approval from your local council (planning or building control) doesn’t replace your duties under the Party Wall Act. You still need to serve notice on your neighbours.

Party wall agreements in Witham: what to know locally

Planning and building control for Witham are handled by Braintree District Council. Witham is in Braintree district. Council approval and party wall consent are separate: even if your project has planning permission, or doesn’t need it, you still have to serve notice under the Party Wall etc. Act 1996 before any notifiable work starts, and your neighbours have 14 days to respond.

The Witham Town Centre conservation area was designated on 19 December 1968 and centres on Newland Street, the historic main street. The council’s appraisal and management plan for Witham Town Centre and Newland Street sets out the character it wants preserved, so extensions and roof alterations there need extra care at the planning stage.

Outside the historic centre, much of Witham’s housing was built in the later 20th century, so many homes are terraced or semi-detached and share at least one party wall.

Because so much of Witham’s housing is terraced and semi-detached, most extensions and loft conversions here involve a party wall or digging near a neighbour. The projects that most often need notice are rear and side extensions (a Section 6 notice if foundations are dug within 3 or 6 metres of a neighbour’s building), loft conversions with steels into the party wall (a Section 3 notice for Section 2 works), chimney breast removal, and new walls on the boundary (Section 1).

Our Essex party wall work is led by Kevin Redman (BSc(Hons), MFPWS, 25+ years, covering Essex and East London), with John Greenan (AssocRICS, MFPWS, ACABE) also covering the county.

How it works

From notice to agreement in four steps

The Building Owner (the person doing the works) has to serve notice and get consent from each Adjoining Owner before work starts.

Talk to your neighbour

We always advise speaking to the Adjoining Owner before notices are served, so they know what to expect.

We serve the notices

We prepare and serve the correct notices after Land Registry checks, with a consent form and a stamped envelope.

Neighbour consents, or a Schedule

If they consent, you can proceed. We always recommend a Schedule of Condition to record their property before work starts.

Award if there’s a dispute

If they don’t consent within 14 days, a dispute is deemed to have arisen and surveyors settle it with a Party Wall Award.

Which notices do common projects need?

Rear extension: typical notices

Witham FAQ

Party wall questions from Witham homeowners

How do I get a party wall agreement in Witham?

Serve a valid party wall notice on every adjoining owner before work starts (one month for section 1 and 6 notices, two months for a section 3 party structure notice). If your neighbour consents in writing, that is your agreement; if they dissent or do not reply within 14 days, surveyors make a Party Wall Award. We serve notices for all your neighbours for £150 + VAT. Step-by-step guide.

How long does a party wall agreement take in Witham?

Notice periods are one month for section 1 and 6 notices and two months for section 3, and the neighbour has 14 days to respond. With consent, the agreement can be in place within that time. If there is a dispute, the time to make the Award varies with the works and the surveyors involved. Notice periods and timescales.

Who pays for a party wall agreement in Witham?

Normally the building owner, including the reasonable fees of the adjoining owner’s surveyor if the neighbour appoints their own (section 10(13)). Our fixed fees are notices £150, notices and a Schedule of Condition £499, and the full package £899 + VAT (£999 + VAT in London). Who pays, and the exceptions.

Who handles planning for Witham?

Braintree District Council. Planning permission and party wall notices are separate, so you may need both.

Does living in a Witham conservation area change the party wall process?

No. Conservation area status (for example Witham Town Centre) means tighter planning controls and fewer permitted development rights, but party wall notices, timescales and our fixed fees are exactly the same.

How much does a party wall agreement cost in Witham?

The same fixed fees apply as everywhere outside London: notices for all your neighbours £150 + VAT, consent with a Schedule of Condition £499 + VAT, or £899 + VAT for the full package with an Award. Everything is invoiced on completion.

How much does a Party Wall Agreement cost in Witham?

Notices for all your neighbours are £150 + VAT. If your neighbour consents subject to a Schedule of Condition, the total is £499 + VAT. If they dissent and an Award is needed, our full fee is £899 + VAT for domestic extensions and loft conversions (no extra cost if we act as Agreed Surveyor for both owners: the usual £50 + VAT supplement is currently waived). Every fee is fixed and invoiced on completion.

How far in advance do I need to serve notice?

At least 1 month before work for Section 1 (new boundary walls) and Section 6 (excavation) notices, and at least 2 months for Section 3 (work to the party wall itself). Your neighbour has 14 days to respond.

Do I need party wall notice if I already have planning permission from the council?

Yes. The Party Wall Act is separate from planning permission and building regulations, so you still need to serve notice where the Act applies.

My neighbour in Witham has served me a notice. What should I do?

You can consent, consent subject to a Schedule of Condition, or dissent and appoint a surveyor. The building owner normally pays the reasonable fees of your surveyor. See our guide for neighbours or call free on 08000 487897.

Is there a party wall notice template I can use?

Yes. Our sister service partywall-notices.co.uk provides correctly worded templates if you’d like to serve notices yourself. Self-served notices are often invalid, though, so many Witham owners prefer us to serve them for £150 + VAT.

Does the Party Wall Act apply to your project in Witham?

Tell us about your project and a local qualified surveyor from our team will confirm which party wall notices you need and your fixed fee. Nothing to pay until the work is done.
